Brillen4you Terms and Conditions (T&C)

1 Scope of Application
Brillen4you will fulfill the order in accordance with the GTC in effect at the time of the order. The GTC are available on our website, updated daily, under the “GTC” link. In case of doubt, the GTC published on the website at the time of the order shall apply. We cannot accept any conflicting terms and conditions.
2 Conclusion of the Contract
The presentation of products in the online store does not constitute a legally binding offer but rather represents a non-binding online catalog. Simply adding products to the “Shopping Cart” does not constitute a binding order. You place a binding order for the products contained in the shopping cart only by clicking the “Order” button on the order page. We will then immediately send you a contract confirmation via email; the contract is concluded upon receipt of this confirmation.
3 Product Offer
All information regarding the goods that the customer receives during the ordering process is non-binding. In particular, we reserve the right to make changes to design and technology that improve the functionality of a product, as well as to correct errors in descriptions, illustrations, and pricing. All technical information regarding individual products is based on the manufacturers’ specifications and is binding within this framework.
4 Delivery Terms
Provided the products are in stock, they will be delivered immediately to the address specified by the customer. Otherwise, a written order confirmation will be issued stating the estimated delivery date. Delivery of the goods (ex-ramp) is at the customer’s expense and risk, even in the case of partial deliveries. Claims for damage to the ordered goods that is visible from the outside will be processed only upon presentation of a certificate from the respective carrier. If an ordered product is no longer available at the time of delivery, Brillen4you expressly reserves the right to replace the product with an equivalent one.
5 Shipping Costs
Shipping within Switzerland is generally via PostPack Priority. Orders with a merchandise value of CHF 40.00 or more are shipped postage-free. For orders with a merchandise value below CHF 40.00, a shipping fee of CHF 4.00 will be charged.
Shipping to the EU is via PostPack International Economy. Orders with a total value of EUR 150.00 or more are shipped free of charge. For orders with a total value below EUR 150.00, a shipping fee of EUR 15.00 will be charged.
6 Terms of Payment
All prices are approximate and are continuously adjusted to market conditions. They are quoted in Swiss francs (CHF), inclusive of VAT, unpackaged, and ex-warehouse Wetzikon. Shipping and packaging costs are billed separately. Payment is generally due net within 30 days of the invoice date.
Purchase on account is only possible after an address and credit check has been completed. The check is performed automatically based on the address data provided. (See Privacy Policy)
Brillen4you reserves the right to supply customers only via prepayment, credit card, or PayPal.

7 Collection
Once the payment deadline has passed, the customer is automatically in default. In the event of late payment, Brillen4you is entitled to:
- Charge collection fees of up to CHF 30 per reminder.
- The outstanding invoice amount, plus any reminder fees and interest, may be transferred or assigned to Intrum AG for collection purposes. Furthermore, the customer is obligated to reimburse all costs incurred by brillen4you or Intrum AG as a result of the late payment.

8 Retention of Title
The delivered goods remain the property of Brillen4you until full payment has been made. Brillen4you is entitled to make a corresponding entry in the retention-of-title register. If the customer defaults on payment of the purchase price, Brillen4you is entitled to rescind the contract and take possession of the goods.
9 Warranty for Defects and Liability
If the customer provides evidence of defects in the delivered goods, we will, within a reasonable time, either remedy the defects or provide a replacement. If we are unable to do so, the customer has the right to cancel the purchase or to a reduction in the purchase price.
Excluded from the warranty are defects caused by normal wear and tear, force majeure, improper handling, tampering by the customer or third parties, excessive strain, or extreme environmental conditions.
10 (Reading) Glasses
Our (reading) glasses are ready-made (reading) glasses with standardized lenses, eye distances, etc. They are not a substitute for custom (reading) glasses fitted by an optician
(reading) glasses. We recommend that you have your vision checked regularly by your ophthalmologist or optician. We assume no liability for improper use or handling.
11 Hearing Aids / Hearing Amplifiers
Our hearing aids / hearing amplifiers are standardized devices that reduce background noise and amplify direct speech. The amplification and noise reduction levels are standardized and not individually tailored to you. We recommend that you have your hearing checked regularly and undergo an audiogram with your ENT specialist or hearing aid specialist. We assume no liability for improper use or handling.
12 Contact Lenses / Confirmation
By placing your order, you confirm that contact lenses have already been fitted for you by an optician or ophthalmologist and that you have been examined by an ophthalmologist or optician within the last 12 months. No complications were found as a result of wearing contact lenses.
You have worn contact lenses—corresponding to those ordered from brillen4you—for at least 6 months without experiencing any discomfort.
If you experience any discomfort from wearing contact lenses, stop wearing them immediately and have your eyes examined by your optician or ophthalmologist right away.
Brillen4you is not liable for any complications, discomfort, or other problems that may arise.
13 Right of Withdrawal
We grant you a right of withdrawal for products purchased from us. Please return the merchandise to us in like-new condition within 14 days of receipt, in its original packaging, for a credit. You are responsible for the return shipping costs. The date the merchandise is shipped is decisive for meeting the deadline. The following items are excluded from exchange: contact lenses, eyeglasses with custom-made lenses based on your personal diopter specifications, and hearing protection. 14 Data Protection
Brillen4you guarantees that it will collect the personal data necessary for business transactions only in accordance with legal regulations. Your data will not be sold, rented, loaned, or otherwise disclosed.
15 Final Provisions
The provisions of Swiss law apply, even if orders are placed from abroad or delivered abroad.
The venue for all claims related to your order is Hinwil. We are also entitled to bring legal action at your general venue of jurisdiction. By placing an order for goods, the customer accepts these General Terms and Conditions.
Any changes or additions to these General Terms and Conditions may be made exclusively by us. They must be made in writing.
