General Terms and Conditions (GTC) of Brillen4you

1 Scope of application
Brillen4you shall execute the order in accordance with the GTC valid at the time of the order. The GTC are available to you on the homepage on a daily basis under the link "GTC". In case of doubt, the GTC published on the homepage at the time of the order shall apply. We cannot recognize any conflicting GTC.
2 Conclusion of contract
The presentation of the products in the online store is not a legally binding application, but represents a non-binding online catalog. If you merely place products in the "shopping cart", this does not constitute a binding order. You only place a binding order for the products contained in the shopping cart when you click on the "Order" button on the order page. We will then immediately send you a contract confirmation by e-mail, upon receipt of which the contract is concluded.
3 Product range
All information on the goods that the customer receives during the ordering process is non-binding. In particular, changes in design and technology, which improve the functionality of a product, as well as errors in description, illustration and pricing are reserved. All technical information on the individual goods is based on the manufacturer's specifications and is binding within this framework.
4 Terms of delivery
If in stock, the products will be delivered immediately to the address specified by the customer. Otherwise a written order confirmation with the expected delivery date will be sent. The goods shall be delivered (ex ramp) at the customer's expense and risk, even if partial deliveries are made. In the event of externally visible damage to the ordered goods, claims will only be settled against a certificate from the respective carrier. If an ordered product is no longer available at the time of delivery, Brillen4you expressly reserves the right to replace the product with an equivalent product.
5 Shipping costs
Shipping Switzerland is generally by PostPack Priority. orders with a value of goods of CHF 40.00 or more are shipped free of charge. for orders with a value of goods below CHF 40.00, CHF 4.00 shipping costs will be charged.
Shipping EU with PostPack International Economy Orders with a value of goods of EUR 150.00 or more are sent postage free. for orders with a value of goods below EUR 150.00, shipping costs of EUR 15.00 will be charged.
6 Terms of payment
All prices are guide prices which are continuously adjusted to the market. They are quoted in Swiss francs (CHF.), including VAT, unpacked, unfranked ex warehouse Wetzikon. Transportation and packaging costs are charged separately. Payment must be made net within 30 days of the invoice date.
Purchase on account is only possible after a successful address and credit check. The check is carried out automatically on the basis of the address data provided (see privacy policy)
Brillen4you reserves the right to supply customers only by prepayment, credit card or PayPal.

7 Debt collection
After expiry of the payment deadline, the customer shall automatically be in default. In the event of late payment, Brillen4you shall be entitled to
-Charge reminder fees of up to CHF 30 per reminder.
-The outstanding invoice amount plus any reminder fees and interest can be transferred or assigned to Intrum AG for the purpose of collection. Furthermore, the customer is obliged to reimburse all costs incurred by Brillen4you or Intrum AG as a result of the default in payment.
"Costs in the event of late payment: processing fee (at the earliest after two written reminders after the invoice date, if handed over to a collection service provider) in accordance with www.fairpay.ch"
8 Retention of title
The delivered goods shall remain the property of Brillen4you until full payment has been made. The latter shall be entitled to make a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, Brillen4you shall be entitled to withdraw from the contract and take possession of the goods.
9 Warranty for defects and liability
If defects in the delivered goods are documented by the customer, we shall remedy the defects or make a replacement delivery within a reasonable period of time. If we are unable to do so, the customer has the right to cancel the purchase or reduce the purchase price.
Defects caused by natural wear and tear, force majeure, improper handling, intervention by the customer or third parties, excessive use or extreme environmental influences are excluded from the warranty.
10 (Reading) glasses
Our (reading) glasses are ready-made (reading) glasses with standardized lenses, eye distances, etc.. These do not replace individual (reading) glasses fitted by an optician
(reading) glasses fitted by an optician. We recommend that you have your eyesight checked regularly by your ophthalmologist or optician. No liability is accepted for incorrect use and handling.
11 Hearing aids / hearing amplifiers
Our hearing aids / hearing amplifiers are standardized devices that reduce background noise and amplify direct conversations. The amplification and reduction values are standardized and not individually adapted to you. We recommend that you have your hearing strength checked regularly and an audiogram carried out by your ear specialist or hearing aid acoustician. No liability is accepted for incorrect use and handling.
12 Contact lenses / Confirmation
With your order, you confirm that you have already been fitted with contact lenses by an optician or ophthalmologist and that you have been examined by an ophthalmologist/optician within the last 12 months. No complications have been detected as a result of wearing contact lenses.
You have used contact lenses for at least 6 months, in accordance with the contact lenses ordered from brillen4you, without any complaints.
If you experience any discomfort from wearing contact lenses, stop wearing them immediately and have your eyes examined by your optician / ophthalmologist straight away.
Brillen4you is not liable for any complications, complaints or other problems that may arise.
13 Right of withdrawal
We grant you a right of withdrawal for products purchased from us. Please return the goods to us in mint condition within 14 days of receipt with the original packaging for a credit note. The costs for the return shipment are to be borne by you. The time of dispatch of the goods is decisive for compliance with the deadline. Excluded from exchange are Contact lenses and glasses with individual glazing and lenses according to your personal dioptric specifications. 14 Data protection
Brillen4you assures that the personal data required for business transactions will only be collected in accordance with legal regulations. Your data will not be sold, rented, lent or otherwise passed on.
15 Final provisions
The provisions of Swiss law shall apply, even if orders are placed from abroad or deliveries are made abroad.
The place of jurisdiction for all claims in connection with your order is Hinwil. We are also entitled to take legal action at your general place of jurisdiction. By ordering goods, the customer accepts these general terms and conditions.
changes or additions to the general terms and conditions are made exclusively by us. They must be made in writing.
